Parents wishing to exercise their right to a second parental leave must notify their employer of their request by registered mail with acknowledgement of receipt, at least four months before the start of the parental leave (article L.234-46 (2) of the French Labor Code).
Your employer does not have the right to give you notice of a preliminary interview (as provided for in article L.124-2 of the French Labor Code) or to terminate your employment contract, from the last day of the notice period for notifying your request for parental leave and for the entire duration of the leave (article L.234-47 (8) of the French Labor Code).
Within a fortnight of the dismissal, you can apply to the President of the Labour Court, who will rule urgently and in the same way as in summary proceedings, to declare the dismissal null and void and order that your employment contract be maintained.
